I am going to take a stab at your question, but please let me know if I
too misunderstood you. As I read it, you want to know why the start
times for recreational crabbing are different in October than they are
in other months. The recreational crabbing times are currently:
B. Recreational. Except for handlines and dipnets, a person may not set
any recreational crabbing gear or catch crabs for recreational purposes
from a boat during:

(1) May through September between:

(a) 5 p.m. and 1/2 hour before sunrise in the main Chesapeake Bay; and

(b) Sunset and 1/2 hour before sunrise in tidal waters tributary to the
Chesapeake Bay;

(2) April, October, November, and December between:

(a) 5 p.m. and 1/2 hour after sunrise in the main Chesapeake Bay; and

(b) Sunset and 1/2 hour after sunrise in tidal waters tributary to the
Chesapeake Bay.

In 2005, Ms. McFaden responded to you that the times were different to
reduce user conflict between the recreational and commercial crabbers.
That is true. The times are different for the months April, October,
November, and December because in 2001 the Tidal Fisheries Advisory
Commission recommended that the start time should be later in the cooler
months. With a limited number of hours to work, the change was intended
to maximize the catch time that crabs are moving around. This is
seasonally variable with temperature. Recreational crabbers start 1/2
hour after the commercial start time to reduce conflicts. Therefore, the
recreational times were amended to reflect this change and crab
availability.

Basically, the crabs are more active later in the day during the colder months. The sun plays a larger role in warming the water during the colder months then during the summer, when the water stays warm all of the time. The time moves to give the commercial crabbers another hour into the warmer part of the day. To avoid conflicts with the recs, their time is also backed up 1 hour for starting. This maintains the same hour difference for starting times as during the summer months. That help?

Not true.  DNR doesn't patrol anymore.  Laws are put in place for honest people to uphold.
