Reds, . . . I don't know about MD but in VA the constitution says
"To the end that the people have clean air, pure water, and the use and enjoyment for recreation of adequate public lands, waters, and other natural resources, it shall be the policy of the Commonwealth to conserve, develop, and utilize its natural resources, its public lands, and its historical sites and buildings. Further, it shall be the Commonwealth's policy to protect its atmosphere, lands, and waters from pollution, impairment, or destruction, for the benefit, enjoyment, and general welfare of the people of the Commonwealth."
To me that means recreational use first commercial use if there is enough left after recreational use. That means pollution, harvest, logging, etc. Don't get me wrong I agree with reasonable harvest limits, etc. as well as commercial fisheries so long as things are sustainable.
You may not agree with the law of the (VA) land (i.e. State Constitution) but it is the law of the (VA) land.

Uh....to me that says the people decide how to manage their resource, not who gets it first.

clean air. . Clean water . . . the use for enjoyment for use and recreation
the what is
public lands, waters, and other natural resources.
What comes after (i.e. if there is enough) develop, and utilize its natural resources . . . .
Oh and the Constitution is the guiding document for our elected and appointed (by the elected) officials not for the people. The people's and the court's job is to make sure that the elected officials follow the Constitution.

SO.................When did the air and waters in Va. get cleanned up??
Lets work on doing that before we put people out of work...
And People were Harvesting Seafood in the Bay and Va. long before they're were people out recreational Boating............

Isn't it true that when dredging, the dredge pulls out crabs but also kills about the same amount?
