Hey Merlin, COMAR is Maryland code Grin

Wrong.

Comar is the Code of Maryland Regulations. Administrative Agencies make regulations. Such as DNR

The Maryland Code is the Annotated Code of Maryland . Wink These are statue or law passed by the legislature.

Some of the fishery laws are in Comar others are not and you must look in the Code.

Little things add up.    A hamburger here, a soft drink there....

People gas up their vehicles.    Chuck gets rentals or gets fees for steaming.    People stop at Wawa.

I have stopped for produce in MD each time I have been over to the Wye.   Saw some antique shops along the way.   Took my wife back on two occasions to browse them and we bought some things.        All together I dropped about $1000 in Maryland between gas, permits, and shopping while there, and that's a $1000 generated simply because I came over there to crab.

Well with 300 cars parked 2 miles up that ramp on a daily basis except Wednesday, Talbot county must be rich with those people spending all that money.  I don't doubt a few of you spend some money, but that is the exception. i have no peoblem with you visiting, but the fee's need to be jacked up  exponentially and the excuse of worring about recripricol fees from your state is a joke.

Reds... they BOTH HAD LCC'S

So the correct me if I am wrong but the facts that I have drawn out of this...
You can charter with a commercial license
      abide by your commercial regulations
lie and just call your paying customers (crew) to satisfy the laws (work comp etc)

What , you mean  there's life outside of MD? I always though that if I crossed the state line I'd fall off the earth.

....and produce, and buying antiques, etc. etc. etc.

My trips into that area, which revolve around the blue crab, have lead me to spend money in that region of MD.

Not the only exception.  Don't know what you're basing your opinion on, but I'd be more than happy to take "before" and "after" pictures of my wallet next time I come down. Undecided

This whole OOS argument is ridiculous.  Should I not drive to DE to watch a NASCAR race because I'm using THEIR resource?  Should I have to pay more than someone who lives in DE to see the race?

The Wye Island area that I fish is a National Wildlife Refuge, which means OOS'ers already help pay for its preservation.  Who cares if I live on the other side of some imaginary line in the dirt?  What would happen to the area if the federal money stopped, and MD residents had to foot the entire bill?  It wouldn't take long before Wye Island was just another overdeveloped pile of dirt.  A lifetime of fishing and crabbing and I will never understand what difference it makes to anyone what state I live in.

Let me comment on this - Reds can jump in if he likes.
You CANNOT charter with just a LCC. To charter you need a Guide License and a Coast Guard License (a copy of which must be on file with the DNR). The Unlimited TFL includes the provisions for the Guide License. If you have a LCC AND a Guide License AND a Coast Guard License you would be legal to carry passengers for hire and crab.

The problem in some cases was DNR Fisheries was telling people that to run crab charters all you needed was a LCC and a captain's license. No guide license was needed. Come to find out DNR Fisheries didn't know the law.
They were saying crabs were not fish and therefore you don't need a guide's license. The law they were reading said "To run fishing charters you need a guide's licenses and a captain's license".
What they didn't look up was the definition in the law of fish. Which is ""Fish" means finfish, crustaceans, mollusks, and amphibians and reptiles which spend the majority of their life cycle in water and any part, egg, offspring, or dead body of any of these species."

A friend of mine was told that by DNR and he was running crab charters without the guide licenses.

Reds, by that definition above, contrary to what you've been posting.......crab charters were harvests exceed that of the recreational crabbers onboard would infact be illegal.

Never quit, do you? The crab charters have NOT been addressed by the DNR or Legislature, until they do there are no laws or regs being broken. If the DNR has a problem with the status quo, I'm sure measures will be introduced. The fact that unlicensed personnel are on the boat doesn't preclude the properly licensed commercial crabber from catching whatever limit he is allowed.
At the end of the day, the people on the boat purchased whatever crabs they end up with from the commercially licensed crabber for whatever price he charged them to be on the boat.. All perfectly legal and NO bushel limits involved.

Chuck may make money on his illegal charters and boat rentals

Duane, I apologize for my previous post (now deleted) saying that you made slanderous remarks.

The point that I was trying to make is that we don't know if Chuck knew the law regarding the charters. We don't know if the DNR field officers themselves knew the law. I was told that DNR boarded Chuck's boat on several occasions during his charters (at sea and ashore) and said nothing.

We just don't know.

But, I'm pretty sure that Chuck knows the law now, as does everyone on the forum. So, going forward, I hope that Chuck sets a 2 bu. limit on this charter catches. If he doesn't then he needs to be reported.

Time to let this topic die.
