DAUPHIN COUNTY POACHING CASE INVOLVES RECORD BOOK BUCK



          HARRISBURG – A Lancaster County resident was cited for poaching a record-book class buck, according to charges filed by Pennsylvania Game Commission in the court of District Justice William Wenner, in Harrisburg, on Dec. 7.

         Wildlife Conservation Officers Mike Doherty of Dauphin County, and John Veylupek, of Lancaster County, filed the charges against Scott M. Garner, 33, of Bainbridge, Lancaster County, who was charged for exceeding the bag limit for antlered deer in a license year by killing a second buck.  Under long-standing bag limits, Pennsylvania hunters are limited to one antlered deer per license year.
         On Dec. 1, Garner killed a 14-point buck in Londonderry Township, Dauphin County, during the two-week firearms deer season after having killed a five-point buck in archery season on Oct. 31.  He re-used and altered his buck tag, originally used on the buck taken on Oct. 31, to tag the second buck illegally harvested on Dec. 1.
         For killing the 14-point buck, Garner faces penalties of up to 90 days in jail and an enhanced fine of $6,500 since the size of the deer’s antlers are considered trophy class under Game Commission regulations. He also faces up to three years revocation of his hunting and trapping privileges in Pennsylvania.   
         Had the 14-point buck been lawfully taken by a hunter, with a Boone & Crockett green-score of 172.5 inches, it would have placed it in the top 25 for typical deer taken with a firearm in Pennsylvania’s All-Time Big Game Records.

he will loose his license and get a fine...  i know of at least 3 people that lost thier license in PA last year...2 of them went and got md licenses thius year...they got fines and lost thier hunting license for a year...one of which was fined/caught  numerous times in MD and has gotten his gun back twice...MD violation was for shooting a deer from 83..( 25" wide 8 pt) and he gat his gun back for that one...go figure

It was on the channel 27 news that they caught him because he posted pictures of 2 buck that he shot on facebook and you are only allowed 1 buck. Now he is saying he is really sorry and he knows he was wrong to do it but it was the biggest buck he ever saw and he got excited and made a mistake. I sure hope they don't let him go with just a slap on the wrist some first time hunter could have got the buck of a lifetime but not now because of some idiot. Yeah Ron your right about that the thing that makes me mad is a kid or maybe somebody that never killed a deer had the chance at a HUGE buck taken away by some moron that got greedy.

No one had a chance at that buck, unless they poached him.

Bet he didnt leave his bed til 2 hours after it was dark and returned 2 hours before the sun came up.

He didnt get that big walking around milling in some corn field during daylight for some kid to shoot, he'd a already been shot!

Ok, playing devil's advocate......if I read right, he was only allowed one buck per year.....shot his one buck with a bow earlier......and went into the woods to hunt for the rifle season......saw this buck during legal hours, and took it.

Correct?

Who here, wouldnt of done the same thing and would have past that beast of a deer up?

You PA guys should push for a new 172 1/4" law. If its larger than that, you can shoot a second buck....cause NO ONE is passing up that thing!!!

Chris I agree with you totally. It is easy to sit here and question his moral terpitude, but given the situation I feel that more would chose the same option he did.IMO  If you have ever "Packed" your bushel to over full, you are guilty of the same offense of poaching. Jealousy is a great motivator for anger. If you can say that you would have let that beast walk, I applaud you. I would like t hope that I could but not sure of it.  Roll Eyes

I agree with you Chris.  It would have been hard to just watch it walk by and I can't say I would have let him go by either but in the heart of the moment.....who knows.  Wink  Al, I agree with you on the crabs...better yet, how many have slipped a peeler in here and there or a hair short of the legal limit?

Was that the buck that was killed a couple years ago? Right from the shoulder of 83? If it was, that was just below one of our farms... I saw pics of that buck that were taken by one of the arresting officers that used to hunt with us. Real shame that that guys can be near a gun as he obviously has no regard for any game laws or other peoples property. I have heard that he has been busted several time killing trophies out of season and by illegal means.........

A guy who works with the state with me, has family from around that region.  Apparently that guy got caught, snitched a loose friend for poaching a couple years prior.  Karma is a b**ch.  Because that guy returned the favor.

LAPEER, Mich. (AP) — After his hunting buddy missed, Jeff Kerr says he couldn’t resist: He shot a 13-point trophy buck on his grandmother’s land in Lapeer County, a deer with a generous rack.
“This is a once-in-a-lifetime rack for a deer hunter,” said Lt. Dave Malloch of the Michigan Department of Natural Resources.
But the antlers and the venison no longer belong to Kerr. The DNR seized everything after learning that Kerr didn’t get a hunting license until after he shot the deer on Nov. 20.
“I was wrong,” Kerr, 28, said Thursday. “I’m not going to point fingers.”
With a construction job going well, he doubted he would get a chance to hunt. Then a pal called and they were off to his grandmother’s 40 acres in Lapeer County’s Marathon Township. Kerr didn’t have a license but had a Remington shotgun.
“He missed it twice and I couldn’t let it go again,” Kerr said of the deer. “I shot him at 10 yards.”
He got a license and removed the deer from the field the next day. He put the animal in his pickup truck and posed for a photo at a shop in Lapeer. The picture was posted on a website where people can see other Michigan trophy deer.  (picture of the buck, follow link)

I shot my first buck about 6 years ago a nice 8 pointer 19 inch spread.Biggest one I had ever seen while hunting since I didn't start hunting untill 2005 I believe.I read all of the rules and heard stories of trucks being taken away etc. if you broke the law.Well I start to get out of my stand and this other buck comes out across the field about 50 yards.I did think about shooting it but I figured with my luck I'd get caught and I was new to hunting so I figured there was a reason for the law which I had no idea what it was.So I figured he would pass on his genetics and it would be good for everyone.Now it's 6 years later and all the farms in the area have verbally agreed to manage the deer to get the biggest possible.I dont own the farm Im just lucky that I get access to it.These guys plant the crops for the deer not really caring about selling the crop.There is every kind of crop you can think of there.They have taught me alot about hunting if you are a multi millionaire,which I'm not.So I see giant bucks quite often and can empathise with someone that has hunted all his or her life where ever they could and had this kind of oppurtunity.I'm not saying they should do it because jail sucks!Anyway just my two cents.
