Crabbing etiquette and rules - rental property in Delaware

Mrs. GV, Lil GV and I rent a house every year down in South Bethany, DE for a week.  This will be our 4th year we've rented from these folks.  We are headed down there this year the last week in June.  The house is not on the beach - it is about a block and a half from the beach.  However, it sits right by a canal.  The past couple years the house behind the one we rent has had a young couple and kids in it.  It is their parent's house.  We've chatted a bit w/ them.  They have set crab pots??? off their deck and caught a few crabs to eat. 

The house we rent technically may not have water access.  It sits on a corner.  We asked the lady who's house we rent (a co-worker and friend of my wife), about crabbing.  Here is an excerpt from her email:

As for crabbing, I have seen crabs in the canal but I am not so sure about eating them (the canals are extremely unhealthy) or where you can catch them. The people behind us are selling their house so they are never there, so if they are not there you may be able to use their little dock. I will find out more about crabbing as we are going down next weekend. Talk to you soon.

So finally - here are my questions. 

Would I need a DE license or is MD reciprocal?
Even if I had permission of the rental house owner, would I need permission from the neighbor?  I'd think so.
As a renter - am I afforded the same crabbing rights of a house owner during that week?
Since the house I'm renting may or may not be considered on the canal - does that still count?
Am I reading this wrong - or in DE you can use pots as long as you check them every 72 hours?  http://www.delcode.state.de.us/title7/c023/index.htm

The property line of the house we rent goes right to the corner of the two other properties.  I'd think if you anchored a pot or trap to a stake one wouldn't need to be on anyone's property.

Thanks - it is a good time and b/c the lady and my wife are friends....we are given a rate that I believe is very fair. 

That is why I ask all these questions before attempting to crab there....I don't want to break the law or get in trouble.....and I don't want the house owner to get in trouble.  I'd think if I can't put some devices in the canal - there would be other spots around there I could handline or use traps.

Firts thing there is no liscense in delaware to crab and you can have two pots per person , so you and your wife 4 pots allowed , name and address is supposed to be on them but nobody says anything if you don't . Grew up in rehobath and my parents used to rent (years ago on the same canals ) and we would catch many crabs, but delaware crabs (small 5" -6" and 7" is a monster , not wye mumbo's . This was years ago ,so maybe with all the building down there the canals are polluted but years ago they were pretty nice .( 25yrs ago) . Wow and I'm only 41 makes me feel old . If you need to buy any Jimmy lynns on rt 1 near the midway movie theaters ( across the road ) has real nice crabs but you will pay for them . Thats a little bit of a hike from bethany but better than the rusty rudder wher you will pay out the nose for them . Any wherein ocean city that i know of is a rip off to buy .I live in ohio now and all this talk is making me homesick and hungry for crabs .Good luck

Been crabing in DE for many years. You don't need a license or anyones permission to crab anywhere you want.  All waterways in DE up to the high water mark are the property of the state and people of DE.  As a property owner you can ony restrict access though your property not the use of the waterway you border.  As a practical matter I try to keep my pots out of the channels used by boaters.  You are allowed two pots for each person.  Best place to buy pots is Mumford Sheet metal Rt 113 in selbyville.  All pots in De has to have the rectangular turtle extruders.  You have to install them yourself.  Any bait shop will have them.  Put name and local address on the pot and I would put them where you can see them.  Big market in stealing crab pots.  Hand lines do ok and so do colapsable traps but you have to tend them.  I don't know how heathly the water in your lagoon is but the water in the little assowoman is pretty good.  Good luck

Wow...you guys had a good time while I was at work today....I was actually up in kingcrabber's neck of the woods in Exton, PA. 

I know....I know - I need to lighten the F up.  I don't want to rent a boat b/c I'm not licensed and 2 months too young to be grandfathered in.  I'm fairly cautious when it comes to these things. 

So I can use a pot for these canals as a "homeowner"?  I thought perhaps I could.  I understand that I would not be able to use them back in MD as a landlocked homeowner.  Anybody have any ideas on where I should get a couple traps?  I'd probably just do two even though the wife could have two as well per ohiocrab....I guess I should put both the rental house address and our address in MD?

As for the Spanish - I grew up in TX......so I'm conversant in Spanish - I just don't look real hispanic....could be a tough sell.

I guess my main concern would be people on the canal that live there full time seeing renters crabbing (if they are not allowed to or are doing it improperly) - getting pissed off and bringing the heat down on us.

As for the speedo - I could post a picture - but I think a flowery description would burn the image into your brains.
I'm 5'11"- balding - 34 in August - 220# (down from 245# 5 months ago) - fuzzy like a bear - bespectacled.

I'm no George Clooney or Brad Pitt.....

As for ohiocrab's assertion that I will fail miserably at crabbing and will need to resort to buying crabs retail - you sir might be right on the money.  It would appear that I might do my first ever crabbing - by myself (the scofflaw).

We have gotten crabs down there from a few different places.  We've eaten at Hoopers.  We have brought crabs back to the house from Mickey's in South Bethany and from the take out place....South Bethany Seafood.

You are pretty sure about no license ohiocrab?  I'm sure the lady that owns the house thinks the canals are polluted - but I'm thinking more full of gook - a crab paradise.

Thank you very much for taking the time to respond.  It would sound then that as long as I stayed on the property that we rent, which we can and anchored the traps to a stake in the ground or to the deck - I could toss them caddy-corner into the canal close to the wall, as to keep them out of boat traffic.

I'm positve no liscense , unless it was installed this year .in delaware . If you don't catch anything fishing at the inlet for rock and blues and weaks is usaually pretty good , right around the coast gaurd station on a high tide . They usually turn on for an 1hr or two especially at night . There is a nice park on the north side and you can drive right up to the railing where everyone fishes , on the south side its not as good and usually packed with campers .Pretty cool for the kids cause you can walk to the  beach and watch all the boats coming in and out of the ocean , currents get real bad at times , too

I can back that no license is required in Delaware.  You are allowed 2 pots per person.  name and anddress must be on floats.  The canal shouldn't be that bad with pollution.

No license is needed-no way!  You do not have to keep your pots on the property that you are renting- you can put them anywhere.  It's not like Maryland. Anyone can put the pots anywhere they want-but of course there is no guarentee that they will be there when you get back! hehehe

It would appear that I need a very ambiguous "white float w/ my name on it" attached to the pot.  I'll have to work on that.  I bought one pot.  They were about $35 - w/ the cull rings and turtle extruder locally.  I figure as I'm on the corner of the canal - throwing several pots (that I'd use once per year)  into a small space would be kinda goofy. 

I'll just toss the one pot w/ white float w/ my name and address on it right into the corner of the canal and attach it back to the pillar of the house we are renting.  That would seem to meet all the criteria listed on DE site.

$35 seems high for a crab pot, where did you buy it?
