I would think you still need to stay 100 feet away from another persons gear no matter what it is.

All the pots I see at the mouth of the river, no way there's 100' between them. Add in those pots that are on a line between flags. But it is a good question. How do you tell if it's a eel pot, are there different markings or floats?
